Which Annual Reporting Packet Do I File?

How Do I Sign Documents?
How you sign documents is important for two reasons. First, you want to show that the ward is the real party in interest. Second, you want to protect yourself from personal liability. See the following examples:
Guardian only:

Don’t Forget These 5 Things!
1. Notify third parties of your appointment.
2. Request copies of important documents and cards.
3. Update all direct deposit and ACH payments.
4. Complete a mail forward to your mailing address.
5. Complete payee (SSA) and fiduciary (VA) applications.

How Do I Reimburse Myself?
New Supreme Court rules effective April 1, 2020 now allow for Guardians and Conservators to reimburse themselves up to $500 per year. Best practice calls for keeping a record of the purchase (for example: receipt) and of the reimbursement (for example: check). Avoid using cash to reimburse yourself. Note: Such reimbursement(s) remain reviewable by the Court.

When is my Annual Report due?
If you were appointed before April 1, 2020, your first Annual Report is due 13 months (1 year + 30 days) after the date your Letters were file-stamped by the Court, and annually thereafter.
If you were appointed on or after April 1, 2020, your first Annual Report is due 13 months (1 year + 30 days) after the date the Order appointing you was file-stamped by the Court, and annually thereafter.
Each year, you will receive a Notice of Reports Due from the Court notifying you of the due date.

Do you charge for initial consultations?

Can my ward pay the attorney fee?
Your ward is permitted to pay up to $1,000 in attorney fees annually.
However, this payment is always subject to Court review. Payment for
attorney fees in excess of the $1,000 annual limit requires Court approve.
Does the Court require background checks?
Generally, the Court requires background checks for the nominated Guardian and/or Conservator.
How long does it take to be appointed Guardian and/or Conservator?
The length of appointment process is different in each County Court and for each case. Estimated length of time can be discussed during your initial consultation.
Can more than one person be appointed Guardian or Conservator?
Nebraska law permits the appointment of Co-Guardians or Co-Conservators. However, some County Courts have adopted a local rule prohibiting such appointments.
Do I have to take a training class?
The Court requires training within ninety (90) days of appointment. The training is offered by Nebraska’s Office of Public Guardian.
Do I have to report to the court every year?
Every Guardian and/or Conservator is required to file a Reporting Packet each year. If you have questions about which Packet to file, see our FREE Tips, above.
Can I get paid for serving as a Guardian and/or Conservator?
In some instances, yes. However, any payment of Guardian and/or Conservator fees by the ward must first be approved by the Court.
Can my ward travel?
Absolutely, and we hope they do! Travel does not require Court permission.
Can my ward move?
Certainly. However, a permanent move to another state requires Court permission.
Can my ward vote?
Yes, and we hope they do!
Can my ward hire an attorney?
In most instances, yes.
